Privacy Policy

Neerwaya strives to protect the privacy of Users by complying with applicable laws and regulations, in particular Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties (hereinafter ‘the Data Processing and Individual Liberties Law’).

This Personal Data Charter forms an integral part of the General Terms and Conditions of Use of the Site.

Article 1 – Definitions

Site: refers to the Neerwaya website accessible at the following address: https://www.neerwaya.fr.

Processing: refers to any operation, or set of operations, involving personal data, regardless of the process used.

User: refers to any user of the Site.

Article 2 – Collection of personal data

While browsing the Website, Users may provide Neerwaya with personal information.

Neerwaya may use cookies in order to analyse traffic to and use of the Site. Neerwaya’s Cookie Policy is available on the Site under the ‘Cookie Policy’ tab.

When using the Site, the following User data may be processed by Neerwaya

Identification details (surname, first name)
Contact details (postal address, telephone number, email address, IP address, etc.)
Bank details

Article 3 – Purposes of processing

Neerwaya collects and processes user data for the following purposes

Knowing and understanding the User’s needs
Verifying the User’s identity
Managing the commercial relationship with the User
Responding to the User’s requests and solicitations
Dealing with questions or requests for information by post and/or electronically and/or by telephone
Producing and analysing statistical data to analyse and improve use, the security and performance of the Neerwaya Site
Handle system errors
Communicate commercial offers, targeted information or advertising to the User
Contractualise the conclusion of the lease
Manage the progress and end of the lease (monitor rental payments, verify insurance coverage, terminate the contract, etc ).

Article 4 – Shelf life

The User’s data is kept for the duration of their Account’s validity and for three (3) months after they unsubscribe.

Article 5 – Consent

By accessing or using the Site, the User accepts the rules relating to the collection, processing and use of Personal Data as set out below.

Article 6 – Processing of personal data

Neerwaya strives to collect and process Personal Data in a fair and lawful manner.

To this end, Neerwaya ensures that the User concerned by the processing is informed of the purpose of such processing, the length of time the processed data will be kept, the person responsible for the processing and the recipient of the processing.

Neerwaya undertakes to make its best efforts to take the necessary measures to guarantee the security of the data it has collected and to prevent their disclosure to unauthorised third parties.

Article 7 – User rights

Users concerned by the processing of Personal Data have the right to object to such processing at any time by contacting Neerwaya in accordance with the conditions set out below. Should this right be exercised, the User will no longer be able to access the functionalities of the Site requiring the processing of his/her data.

Users also have the right to access, rectify and delete their data, allowing them to access information concerning them and to demand that their data be rectified, completed, updated or deleted, as appropriate.

The User also has the right to portability, which allows him/her to retrieve the data processed by Neerwaya for his/her personal use and/or to transfer it to a new organisation.

The User’s request must include his/her last name, first name, date of birth, postal address and e-mail address.

Neerwaya will respond within 2 months of receipt of the User’s request.

Article 9 – Recipient of processing

The User’s personal data may be communicated by Neerwaya to the following third parties: computer specialists in charge of site maintenance.

Administrative or judicial authorities, when such disclosure is necessary for the identification, apprehension or prosecution of any individual likely to prejudice the rights of Neerwaya, any other User or any third party.
The TRAFCIN unit (article L. 561-2 of the French Monetary and Financial Code)
Neerwaya’s service providers and subcontractors providing a service on behalf of Neerwaya and/or in its name in order to enable Neerwaya to provide its services.

Article 10 – Security of personal data

Neerwaya makes its best efforts to ensure the security of the User’s Personal Data by implementing physical, electronic and administrative technical protection measures proportionate to the risks incurred and in compliance with applicable regulations.

Neerwaya cannot be held responsible for risks related to the operation of the User’s Internet network. It is the User’s responsibility to ensure that appropriate security measures are in place.
